Credit Card Theft

Camden County NJ Credit Card Theft Lawyer

Criminal Defense Attorney in Camden, New Jersey

New Jersey has enacted extensive restrictions and laws involving credit cards, most of which are contained in section N.J.S.A. 2C:21-6 of the New Jersey Criminal Code. This statute encompasses a vast array of offenses, which can be delineated among two distinct categories: offenses involving the way in which a credit card is obtained, and those that involve the way in which a credit card is used. These crimes can be broadly referred to as “credit card theft” and “credit card fraud.” Depending on the specific offense for which you are accused, you may face third or fourth degree charges, both of which are considered felonies and are punishable by a term of incarceration in New Jersey State Prison. Each credit card-related offense requires the State to provide specific evidence to prove these charges beyond a reasonable doubt. When facing credit card theft or fraud charges, a knowledgeable attorney can thoroughly examine your case and construct a compelling defense that undermines the prosecution’s arguments and positions you for the most favorable result.

Over the course of many years, criminal defense attorney William Fay has achieved thousands of dismissals and successful results for clients in courts throughout Camden County and South Jersey. Credit Card Theft in New Jersey

According to N.J.S.A. 2C:21-6, there are a number of offenses that constitute credit card theft under New Jersey law. The following is an outline of each of the actions that may lead to credit card theft charges.

  • A person takes or obtains the credit card of another person without the cardholder’s consent.
  • A person receives a credit card that he or she knows has been taken, with the intent to use it, sell it, or transfer it to another person other than the issuer or the cardholder.
  • A person receives a credit card that he or she knows been lost, mislaid, or delivered by mistake, and retains possession with the intent to use it, sell it, or transfer it to another person other than the issuer or the cardholder.
  • A person, other than the issuer, sells a credit card.
  • A person buys a credit card from another person, other than the issuer.
  • A person, with the intent to defraud the issuer, a person, or organization, obtains control over a credit card as security for a debt.
  • A person other than the cardholder or a person authorized by him or her, with intent to defraud the issuer, a person, or organization, signs a credit card.

All of the above offenses are classified as fourth degree crimes, which are punishable by a New Jersey State Prison sentence of up to 18 months, as well as a fine of up to $10,000. If a person possesses credit cards issued in the names of 2 or more other people, or possesses 2 or more stolen credit cards, he or she is presumed to have committed credit card theft.

Falsely Making or Embossing a Credit Card in New Jersey

Notably, there is another offense which is considered credit card theft in New Jersey, which involves making or embossing false credit cards. Specifically, if a person, with the intent to defraud a purported issuer, person, or organization, falsely makes or falsely embosses a credit card or presents such a card, he or she may be charged with credit card theft. If a person possesses 2 or more falsely made or embossed credit cards, he or she is presumed to have committed this offense. This form of credit card theft is classified as a third degree crime, which is punishable by a term of imprisonment ranging from 3 to 5 years, in addition to a fine of up to $15,000.
